Terms of Services

The following Terms outline the use of our WordPress Maintenance Plans (aka the “Plan” or “Plans”). Before signing up for a Plan, we ask that you take a moment to review the following Terms of Services which govern our relationship with you in relation to the Plans.

By engaging the services of Webvolutions LLC (aka “Webvolutions”), you acknowledge that you have read and understood this document, and that you agree to be bound by these Terms.

Scope of Services

You are engaging Webvolutions to perform maintenance services and offer email support for one single-site WordPress installation. Each Plan includes:

  • Email support
  • WordPress, Theme, and Plugin Updates
  • Content update and troubleshooting
  • Website Backups
  • 24/7 Security Monitoring

The Plans covers support for one WordPress sites owned by the same client. When signing up for an Unlimited Plan, you must provide us with the site that will be covered by the Plan.

The Services provided under the Plans cannot be transferred to another website not owned by the Client. Webvolutions reserves the right to refuse service for a website that was not declared by the Client upon sign up to a Plan.

The Plans do not cover support for multi-site WordPress installations, eCommerce or Membership installations.

Support Requests

Support must be requested by email to ensure accuracy and tracking of the request. We do not accept phone requests or offer phone support.

Requests must be sent to We will acknowledge receipt of your request by email. If your request does not fall within the scope of your Plan, we will provide you with a fee estimate to accomplish the task you requested.

Upon completion of the task, we will send you an email confirmation.

The effort and time required to perform a task will be determined exclusively by Webvolutions.

Support requests can be placed between 8am and 6pm PT, Monday through Friday, with the understanding that requests submitted in the afternoon are most likely to be completed on the following business day.

Support requests placed on Saturday or Sunday will be handled on the following Monday, or on the next business day should Monday be a bank holiday.

Types of requests

The following are examples of requests that typically fall under the scope of services of the Plans:

  1. Content edits and content population
  2. Image manipulation and optimization
  3. Page content changes
  4. Blog posting
  5. New page creation based on an existing layout
  6. Portfolio posting
  7. Element styling with CSS
  8. WordPress theme and plugin troubleshooting
  9. HTML and CSS troubleshooting
  10. WordPress consulting or advice
  11. Any small task generally deemed by Webvolutions to take an hour or less of development time

Requests must be submitted one at a time. If you choose to submit more than one request at once, Webvolutions reserves the right to break your requests in smaller tasks of no more than 1 hour each. Webvolutions is under no obligation to work on a task until the previous one has been completed.

Services not included

The following are examples of requests that are not included in the Plans. If requested, these tasks will be performed at an agreed upon rate.

  1. Large website redesign
  2. Content creation or media creation
  3. Custom Theme development
  4. Custom Plugin development
  5. Search Engine Optimization Services or search marketing Services
  6. Website deployment to additional URLs
  7. Javascript modifications/troubleshooting
  8. Website or hosting migration
  9. Email migration
  10. Logo creation
  11. eCommerce or Membership Implementations
  12. Any other task that Webvolutions deems to exceed the scope of the Plans

WordPress Versions

The Plans support WordPress installations that are no more than 2 major release versions older than the current WordPress core version.

If your WordPress version is more than 2 major releases old (for example, if the current core version is 4.9.x and your installation is 4.6.x or older), the upgrade can only be done manually and there is significant risk that an upgrade may damage files or cause conflict issues with themes or plugins.

If you require Webvolutions to upgrade a WordPress installation that is more than 2 major releases old, there will be an additional one-time fee of $400 to complete this task, and you agree to discharge Webvolutions from any responsibility or consequence that may arise from a failed update of the WordPress core.


You agree that you will pay for the Plan provided by Webvolutions. You are responsible for the timely payment of all fees and for providing Webvolutions with a valid payment method for the payment of all fees.

Full payment of the Plan fee is due every month on the renewal day of your subscription. For additional requests or tasks that fall outside of the scope of Services of the Plan, you agree to pay in full prior to the beginning of the work. Webvolutions is in no obligation to begin working on the task until payment has been received in full.

Upgrade/downgrade of Services

You are free to upgrade or downgrade between Plans, but you can’t switch Plans more than twice in a calendar year. The upgrade/downgrade will take effect on the renewal day of your subscription that immediately follows your request to upgrade/downgrade Plans. Requests to upgrade or downgrade must be submitted to

Cancellation of Services

You are free to cancel your service at any time. The termination of your Plan will take effect on the last day of your current subscription month. Webvolutions will not offer any refunds or pro-rate the current month’s maintenance fee following a termination request.

To cancel your Maintenance Plan, simply send a cancellation request to and we will acknowledge receipt and confirm the cancellation date.

Webvolutions reserves the right to terminate or suspend any and all Plans immediately, without prior notice or liability, for any reason whatsoever, or for no reason, including without limitation, if you breach these Terms of Service.

You may choose to re-activate your subscription after cancelling it. To account for all the maintenance work that will have to be performed since your subscription was cancelled, when you sign up for a Plan again, there will be a $150 fee for every month that your subscription was inactive, with a minimum of one month due.

Webvolutions reserves the right to refuse future sign-ups once a subscription has been cancelled.

Limitation of Liability

You hereby expressly and irrevocably release and forever discharge Webvolutions from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of your use of the Services.

You hereby agree to indemnify and hold harmless Webvolutions from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, punitive, exemplary and indirect damages), and reasonable attorneys’ fees, relating to, resulting from or arising out of, in whole or in part (i) any breach of these Terms, whether or not deemed to be material or immaterial; (ii) the use of or reliance upon the Services, by you or any person acting on your behalf; or (iii) any material or immaterial violation of any rights, title or interests of any third party.

In no event shall Webvolutions be liable to you under any legal or equitable theory, including but not limited to contract, tort, strict liability, negligence, common law or with respect to the Services provided for any lost profits, loss of use, or actual, special, indirect, incidental, punitive, or consequential damages of any kind whatsoever. You understand that your sole remedy for any damages you allege have been sustained as a result of the Services is to cancel your Plan.
